THE SUSPENSION & DEBARMENT: LESSONS LEARNED FROM IBM

The recent suspension of IBM showed the surprising impact a suspension or debarment can have well beyond the affected contractor. Although IBM was quickly removed from the Excluded Parties List System (EPLS), these questions remain. Contractors and agencies alike may benefit from a "refresher" on suspension and debarment and how it affects not only the listed contractor but also non-listed contractors who sub or team with the listed contractor and agencies who rely on the listed contractor at either the prime or sub level. All members of the contracting community are wise to revisit suspension and debarment so that they are prepared the next time a major federal vendor is placed on the EPLS.
This program is designed to teach about the impact and response to suspension and debarment from three perspectives: (1) the listed contractor; (2) Contracting Officer's who rely on the listed contractor to meet current agency requirements; and (3) non-listed contractors who rely on the listed contractor as either a subcontractor or teaming member. Drawing on lessons learned from the recent IBM suspension, our expert panel of two federal Suspension and Debarment Officials and two government contracts attorneys will discuss:

Listed Contractor: What are your rights and remedies to challenge a suspension and debarment? What are effective strategies? What does the Government look for to remove you from the list? What happens to your current contracts and subcontracts while you are listed?

Non-Listed Contractor: Can the listed contractor continue to perform existing contracts. Can the listed contractor receive new task orders under existing IDIQ contracts? What happens if you are teaming with the listed contractor to bid on a new contract?

Contracting Officers: Can the listed contractor continue to perform existing prime contracts? Can a listed contractor continue to perform existing subcontracts. Can a listed subcontractor receive new task orders under existing IDIQ contracts at either the prime or sub level?
Does the agency have any options to "override" the suspension and continue to do business with the listed contractor?
